>>> The 'Weekend of Awakening', presented five years ago TODAY, was dedicated to the term that had never been used on this blog before -'The Norval Morrisseau Conspiracy'.


Among the information never before seen on the 'NORVAL MORRISSEAU BLOG' a series of signed 'Certificates of Authenticity' had been presented for paintings done in the styles that Norval Morrisseau used mostly during the decade of the 1970's. These legally binding 'Cerificates of Authenticity' were signed and thumbprinted by Norval Morrisseau as he personally handled and inspected the 'front and reverse' of each canvas painting for his identifying marks. These 'Certificates of Authenticity' were eyewitnessed during their presentation to Norval Morrisseau in 2002 and certified by forensic science in 2011 (click HERE & HERE). All of these genuine Norval Morrisseau paintings were signed by the artist with a dry brush (DB) technique.

From the very beginning of the NORVAL MORRISSEAU BLOG I felt the need to create a platform that will speak for Norval when this privilege to speak for himself was put in the hands of others that were only interested in their personal financial gain by putting the Legacy of Norval Morrisseau aside.

"KRG SLAPP Suit Target Ugo Matulic of Calgary, Alberta, celebrates his total judicial triumph (May, 2013) and vindication, outside Toronto’s Kinsman Robinson Galleries, whose principals sued him for One Million Dollars for “defamation” in 2010. Ugo is famous in Canadian history as the first person ever taken to court by the Morrisseau Conspiracy Theorists. Though they have had 13 years to take “thousands of forgeries and umpteen forgers” to court they have never done it, even once, knowing full well they have no believable evidence, of any kind, that will hold up in any court. Instead the Principal Conspiracy Theorist, the Junior Morrisseau Conspiracy Theorist, who work inside this gallery – alongside the Principal Blogging Conspiracy Theorist – have targeted Morrisseau researchers and investigative journalists, to try to shut them up, and stop them from exposing what has been called “the greatest fraud in Canadian art history.” Matulic has amassed what can only be called a stunning collection of compromising documentary evidence that catalogues (my call) the history of the biggest hoax, as well as the biggest act of cultural genocide, in Canadian history. AFTER THIS PICTURE WAS TAKEN MATULIC WENT INSIDE... TOURED THE GALLERY, CHATTING AND SHAKING HANDS WITH JOHN MACGREGOR NEWMAN, THE ASSOCIATE DIRECTOR OF THE GALLERY. No one recognized the man they had been attacking and defaming for years on the KRG corporate blog, and against whom they had launched a totally specious million dollar SLAPP suit."

The far reaching implications if Kinsman Robinson Galleries had silenced my voice would have been felt for decades. This court case Kinsman Robinson Galleries vs. Ugo Matulic, together with Hatfield vs. Artworld of Sherway, enhanced the value of not only Norval Morrisseau's but the future of all First Nations art as well. 

The Plaintiffs (Kinsman Robinson Galleries, Donald Robinson and Paul Robinson) demanded from the court the following:

"(d) an order requiring the Defendant to publish a clear and unreserved retraction on the Blog, as defined below, in respect of the Defamatory Words in a fashion that is at least as prominent as the Defamatory Words that appeard on the Blog;"

"(e) an order the Defendant to delete or destroy all electronic and physical copies of the articles containing the Defamatory Words;"

"(f) an order requiring the Defendant to provide the Plaintiffs with the identity of any person or corporation that hosts, publishes, republishes or posts links to the Defamatory Words, including the identity of the Defendant's internet service provider ("ISP");"

"(g) an order requiring the Defendant to send written requests to any person or corporation that hosts, publishes, republishes or posts links to the Defamatory Words, including Defendant's ISP;"

BLOG MASTER'S COMMENT: I very successfully succeeded in defending this frivolous SLAPP suit and I will continue pursuing our mission of seeking justice for Norval Morrisseau and his art, which is a vital aspect of Canada’s heritage.

IMPORTANT NOTES: I was in the process of submitting a long list of documents they would be required to produce that they have hidden from public scrutiny for the last 13 years. And they knew that is what they would have to reveal. Also financial documents, which actually show their profits went up from the Hoax, and not down from my revelations.

The Plaintiffs (Kinsman Robinson Galleries, Donald Robinson and Paul Robinson) signed the Full and Final Release dropping all charges against me as soon as the judgement by Judge Paul J. Martial in Hatfield vs. Artworld of Sherway was announced.

In this court case the Plaintiff (Donald Robinson) was stripped of most of the claims he has ever made as a Morrisseau expert and authenticator of Norval Morrisseau's artworks. Judge Paul J. Martial rejected his so-called "expert report”, his analysis, his conclusions, and his abilities as Morellian analyst and a handwriting expert (click HERE for more info).

An UPDATE on Ontario anti-SLAPP legislation... (Part I)


It's time for Ontario to ban SLAPPs - lawsuits brought by big companies to silence resource-poor defendants and chill free speech.


 
Ontario NDP leader Andrea Horwath was the first to table a bill aimed at banning SLAPPs, dubious lawsuits often brought by deep-pocketed companies with the specific aim of silencing resource-poor defendants.
 
 
Ontario must ban SLAPP suits to protect free speech

Freedom of expression and democracy are being undermined in Ontario. A panel of experts convened by the Ontario government in 2010 found that the threat of abusive lawsuits claiming massive damages, especially for defamation, is deterring “significant numbers” of Ontarians from speaking out on issues of important public interest.

However, there is now hope that action will be taken to address this problem, as the province’s political parties find themselves in rare agreement that it is high time to deal with this threat through strong legislation.

Known as SLAPPs (Strategic Litigation Against Public Participation), these dubious lawsuits are often brought by deep-pocketed companies with the specific aim of silencing resource-poor defendants. And they are very effective. The defendants, usually ordinary citizens or public interest groups, naturally feel threatened by the prospect of massive legal fees, disruption of their activities and the possibility of large damage awards. Even when the lawsuits have no merit whatsoever, they often result in a chill on free speech.

Comments on a wide range of public interest issues have attracted SLAPP suits in the past. These include reporting on environmental violations by large companies, exposing corruption and other forms of wrongdoing, and criticizing the behaviour of powerful individuals. In other words, SLAPPs are an attack on democracy. They undermine the ability of civil society and private individuals to act as watchdogs over the powerful.

Unfortunately, the threat of facing a SLAPP suit in Ontario is very real today. Greenpeace Canada is currently fighting a $7-million lawsuit brought by logging giant Resolute Forest Products. Dylan Powell, founder of small environmental NGO Marineland Animal Defence, currently faces a $1.5-million SLAPP from Marineland. The issue of SLAPPs first gained prominence in Ontario when Big Bay Point residents were hit with multimillion-dollar lawsuits by developers.

We need legislative protection from these chilling lawsuits. Anti-SLAPP legislation may affirm a legal presumption in favour of the protection of speech on matters that are of public interest, or engage public participation. If the defendant can demonstrate that his or her statements fall within the scope of this presumption, the burden then shifts to the plaintiff who must show that the case has substantial merit, that it is unlikely that any defence would succeed and that, on balance, the harm it has suffered outweighs the harm that would be done to the public interest if the case were to proceed.

Anti-SLAPP legislation has already been adopted in Quebec and most U.S. states. It’s now time for Ontario to follow suit. Important steps have been taken in this regard, specifically in the form of Bill 83, submitted by the Attorney General to the Ontario legislature in May 2013 – the first government-sponsored anti-SLAPP bill in Ontario.

This follows the first ever Ontarian anti-SLAPP bill, put forward by Andrea Horwath of the NDP as a private member’s bill in 2008. The Progressive Conservatives have also voiced support for this type of legislation, noting that abusive lawsuits represent a serious waste of taxpayer dollars.

Despite these positive steps forward, we are concerned about whether there is sufficient political will to see this through. The parties must not delay in adopting legislation that will champion the human rights of ordinary Ontarians, allow for robust debate on matters of public interest, save taxpayer money and uphold confidence in our legal system and our democracy.

Our organizations, along with more than 150 environmental organizations, free speech groups and unions, call on the Ontario legislature to pass anti-SLAPP legislation as a matter of priority. No less than 64 municipalities and the Ontario Bar Association have also supported anti-SLAPP legislation. It is time to protect Ontarians’ right to free expression.

Alone against the “Establishment” this Canadian Morrisseau collector took on the biggest media giant in Canada (CTV Globemedia) and won a stunning moral, legal, and cultural victory, on March 10, 2009, on behalf of Canada, and all Canadians, and the artistic heritage of Norval Morrisseau.

The lonely battle he fought, at great personal expense, and distress, over two years, served to expose for all Canadians, how – from the very beginning - serial journalistic incompetence continues to be the main tool harnessed by those who attack the painting legacy of Norval Morrisseau, and in the process – together – grievously undermine and devalue the legitimate Aboriginal cultural heritage of Canada.

Along with professional appraisal work done by Maslak Mcleod Gallery in Toronto Ontario by Mr. Joseph McLeod a member of ADAC & the Canadian Public Appraisers (see Exhibit No. 24 b). Further forensic work was conducted and found proof positive for the signature painted in black paint on the verso of 'FATHER AND SON' dated 1977 by Mr. Brian Lindblom of 'The Document Examination Consultants Inc.'

See Exhibits No. 10 & Exhibit No. 24 a ). - The 'Document Examination Consultants Inc.' are noted for their forensic expertise and called upon by various law enforcement agencies such as the RCMP to conduct forensic examinations to be used in a court of law. Go to "Personnel" section of their website to access PDF version of Mr. Brian Lindblom's CV.  This type of work is forensics at it's best and is quite costly to employ. This kind of examination was done under the eye of un-biased professional scrutiny.

The forensics work can only be conducted using many publicly known signature and writing sample specimens of Norval Morrisseua's signature as it is found on prints, personal letters and publicly known artwork created by Norval Morrisseau.

All specimens of writing archived by the examiners were used in determining the author of the signature and title painted on the verso of 'Father and Son' along with other paintings I own. Money well spent.

Randy Potter

A positive Identification of the signature was made and determined that it was done by the hand of 'Norval Morrisseau' Canadian Woodland Artist through a multiple point grade system.
The painting 'Father and Son' can be sourced back to Khan's auction house sold by Mr. Randy Potter (auctioneer) to Michael Moniz in early 2007 and sold afterwards on eBay.com to a collector in Toronto who will remain nameless to protect this individual's right to privacy.

Two paintings once owned by Mr. Joseph Otavnik were also examined by the document examiners and two other paintings I own as well (Sacred Medicine Bear, 1979 and Sacred Medicine Wheel, 1975). These four other paintings were found once again to have positive signature identifications authored by the brush of Norval Morrisseau.

Forensic work was also employed by Mr. Jim White who is an art dealer from Ontario on six paintings he had examined by the same forensic firm 'Document Examination Consultants Inc.' years ago. Mr. Joseph Otavnik and I have used the same firm for a forensic signature evaluation of the paintings from our collections. The six paintings owned by Mr. Jim White came back also with proof positive signatures painted on the verso of each piece authored by Norval Morrisseau.

All of these paintings including 'Father and Son' came from Randy Potter's auction house and through Mr. David Voss a Thunder Bay collector (see Exhibit No. 9). One can link themselves into Mr. Otavnik's case for an in depth exploration of this man's case of Otavnik vs Vadas SC 07-51428-00 (see Exhibit No. 24) and see for yourself the importance and power of forensic science.

The painting 'Father and Son' was pictured in the February 2007 Globe&Mail article "Old Art Scam surfaces on-line" by the late Val Ross (this post cannot be found online anymore because it has been deleted by the Globe&Mail's editors). The article's accusations were slanderous and damaging to say the least. The Val Ross article is full of lies and mis-information fed to Val Ross a reporter for the Globe&Mail by the individuals doing the speaking in the article. I need not have to repeat their names once again.

Norval Morrisseau has now been vindicated and victory has been won!

Justice has been found for Norval Morrisseau.

Indeed 'the Father has now found his Son'...

NOTES: Due in fact to individuals and galleries that were closely associated with the artist have been spreading false statements that paintings of a certain style were not done by Norval Morrisseau's hand. Particularly those from the 1970's such as "Father and Son" (1977) presented in this posting. I understand fully now that they are trying "to harness" the secondary market and litigation proceedings have begun with many involved against this small group of people spreading dis-information to the public.

By discrediting a large body of work by Norval Morrisseau shows us all a great disrespect to the artist and their actions will never be tolerated. By doing disservice to the most important Canadian painter; they have tried to harm the Norval Morrisseau Art Market and consequently his legacy and have failed in their actions. The painting(s) executed in the 1970's style and signed presented in these post(s) are authentic pieces of art authored by Norval Morrisseau and forensic science backs up this claim!
