The children of Norval Morrisseau have filed a lawsuit challenging the last will and testament of the acclaimed Ojibway artist.
-
Lawyers representing the aboriginal artist's seven children filed the lawsuit in B.C. Supreme Court in Vancouver on Wednesday.

-
"We want to honour dad's legacy as one of the greatest Canadian and aboriginal artists. I believe dad wanted his estate to stay in the family. I know he wouldn't disinherit us on purpose," Victoria Morrisseau Kakegamic, the artist's daughter, said in a statement.

-
The lawsuit involves control over the right to use Morrisseau's name and images, as well as the right to reproduce his colourful acclaimed artworks, which are held in galleries and collections across Canada and around the globe.

According to the statement of claim, Morrisseau's children have requested the court declare his will invalid.

The documents allege undue influence by Gabor Michael Vadas, the artist's close friend who was named executor, trustee and sole beneficiary of the estate under the current will, which dates from July 1999.

The lawsuit alleges that the will was executed under suspicious circumstances, including while Morrisseau was "physically, mentally and emotionally frail" from Pa
rkinson's disease and "dependant on Vadas for all aspects of his day-to-day existence."

The filing also alleges that Vadas kept the artist away from his family, was verbally abusive towards him, controlled Morrisseau's life and profited from his artwork.

Died in 2007

In December 2007, Morrisseau died in Toronto at age the age of 75, following a long battle with Parkinson's. He was buried on a reserve in northwestern Ontario about a month later, following a protracted battle over his final wishes for his remains.

Morrisseau's brother, Bernard, and Vadas contended that he had asked to be cremated.

-
However, the artist's children demanded that he be buried next to their mother, Harriet Kakegamic, whom he had married in 1957. The couple later separated.

Born and raised near Thunder Bay, Ont., Morrisseau was the founder of what became known as the Woodland school of painting and inspired generations of aboriginal artists.

However, he also battled alcohol abuse and was homeless in Vancouver when he met Vadas in the late 1980s. Vadas, a former street kid, and his wife Michele Vadas became the artist's main caregivers for more than a decade.

Vadas has yet to return CBC requests for comment on the lawsuit.

Art Dealers Association of Canada (ADAC); currently a member of The Canadian association of Personal Property Appraisers (CPA).

Further forensic work was conducted and found proof positive for the signature painted in black paint on the verso of 'SACRED MEDICINE BEAR' dated 1979 by Mr. Brian Lindblom of 'The Document Examination Consultants Inc.'.
-
The 'Document Examination Consultants Inc.' are noted for their forensic expertise and called upon by various law enforcement agencies such as the RCMP to conduct forensic examinations to be used in a court of law. This type of work is forensics at it's best and is quite costly to employ. This kind of examination was done under the eye of un-biased professional scrutiny.

The forensics work can only be conducted using many publicly known signature and writing sample specimens of Norval Morrisseua's signature as it is found on prints, personal letters and publicly known artwork created by Norval Morrisseau.
-
All specimens of writing archived by the examiners were used in determining the author of the signature and title painted on the verso of 'Sacred Medicine Bear'.
-
A positive Identification of the signature was made and determined that it was done by the hand of 'Norval Morrisseau' Canadian Woodland Artist through a multiple point grade system.
The painting 'Sacred Medicine Wheel' can be sourced back to Khan's auction house sold by
Mr. Randy Potter (auctioneer) to Mr. Michael Moniz.

Two paintings once owned by Mr. Joseph Otavnik were also examined by the document examiners and three paintings in Mr. Michael Moniz's collection: Father and Son, 1977; Sacred Medicine Wheel, 1975 and Sacred Medicine Bear, 1979 featured in this article. These five paintings were found to have positive signature identifications authored by the brush of Norval Morrisseau.

Forensic work was also employed by Mr. Jim White who is an art dealer from Toronto on six paintings he had examined by the same forensic firm 'The Document Examination Consultants Inc.' years ago. Mr. Joseph Otavnik and Mr. Michael Moniz have used the same firm for a forensic signature evaluation of the paintings from their collections. The six paintings owned by Mr. Jim White came back also with proof positive signatures painted on the verso of each piece authored by Norval Morrisseau.

All of these paintings including 'Sacred Medicine Bear' came from Randy Potter's auction house and through

>>> The first above presented Norval Morrisseau's painting titled "Shaman and Flower Tree Loons" (1980) had been disrespectfully labeled as a 'forgery' by Mark Anthony Jacobson a.k.a. PEY-SIM-AWAY-APEY-BINASI (click HERE). This painting is among the other authentic paintings not included in 'fake and imitations' list in Norval Morrisseau's signed affidavit from November 30th, 2004 regarding paintings at Mr. Gary Lamont's www.woodlandartgallery.ca. Click HERE to view this painting (page 8) which is not part of 'fake and imitations' list (pages 1 - 4). The second painting presented above titled "Fish and Fish with Spirit Loon" (1983) is also not included in 'fake and imitations' list of the same affidavit (click HERE ti view this painting on page 7). These two artworks which are executed in very similar painting style if shown in 'fake and imitations' list they should have appeared on page 2 (between 'Arrangement on Brown' & 'Sacred Fish') of this signed affidavit as the paintings' titles were listed in order of appearance. As their titles do not appear anywere in 'fake and imitations' list they are considered authentic works of Norval Morrisseau as per artist's signed affidavit from November 30th, 2004 (click HERE).

Note: Mark Anthony Jacobson a.k.a. PEY-SIM-AWAY-APEY-BINASI has labeled other paintings 'fakes' which were also acquired by Mr. Gary Lamont directly from the artist. This will be addressed in one of this blog's future posts.

It is strange that paintings involved in a court case Zelinski v. The Queen, (No. 92-424) were also acquired directly from the artist through Mr. Gary Lamont, who served as a mediator between Norval Morrisseau and the said party of lawyers, and the same were appraised by Donald C. Robinson of Kinsman Robinson Galleries (click HERE).

It is a shame that individuals like Ritchie 'Stardreamer' Sinclair, Gabor (Gabe) Vadas and Mark Anthony Jacobson a.k.a. PEY-SIM-AWAY-APEY-BINASI are labeling paintings acquired by Mr. Gary Lamont directly from Norval Morrisseau as 'fakes' and 'abominations' and at the same time they are in full support of Donald C. Robinson who appraised paintings coming from the same source (click HERE)!? These individuals are not just trying to discredit Mr. Gary Lamont and large body of Norval Morrisseau's works executed in predominant 1970's style but also those paintings that came from the 1980's - the same period of the "Shaman and Flower Tree Loons" (1980), "Fish and Fish with Spirit Loon" (1983) and paintings in a court case noted above which were donated to number of museums and galleries all across Canada.

~ Also, Mark Anthony Jacobson a.k.a. PEY-SIM-AWAY-APEY-BINASI was the one who together with Gabor (Gabe) Vadas approved Bryant Ross' cowardly act of destroying one of the authentic Norval Morrisseau paintings (click HERE).

IMPORTANT NOTES: This Norval Morrisseau's signed affidavit dated November 30th, 2004 had never been sent to Mr. Gary Lamont while Norval Morrisseau was alive because Mr. Lamont only became aware of it in 2008. Gabor Vadas had many opportunities to deliver this affidavit to Mr. Gary Lamont including the time when Mr. Lamont visited Norval Morrisseau in Nanaimo, BC on May 18th, 2005 (click HERE... see last three images at the bottom of page).

Gabor Vadas did not have the decency to hand this affidavit to Mr. Gary Lamont and I do not believe he ever had intention to do so neither, and he 'conveniently' waited for Norval Morrisseau to die before exposing it to the public and consequently to Mr. Gary Lamont.

Also, I do not believe that Norval Morrisseau would have ever presented such a strong statement about paintings listed in this sworn affidavit without expressing 'his' concerns to his very good friend Mr. Gary Lamont who is the owner of www.woodlandartgallery.ca.
