Kinsman Robinson Galleries vs. Ugo Matulic /CV-10-417123/
"KRG SLAPP Suit Target Ugo Matulic of Calgary, Alberta, celebrates his total judicial triumph (May, 2013) and vindication, outside Toronto’s Kinsman Robinson Galleries, whose principals sued him for One Million Dollars for “defamation” in 2010. Ugo is famous in Canadian history as the first person ever taken to court by the Morrisseau Conspiracy Theorists. Though they have had 13 years to take “thousands of forgeries and umpteen forgers” to court they have never done it, even once, knowing full well they have no believable evidence, of any kind, that will hold up in any court. Instead the Principal Conspiracy Theorist, the Junior Morrisseau Conspiracy Theorist, who work inside this gallery – alongside the Principal Blogging Conspiracy Theorist – have targeted Morrisseau researchers and investigative journalists, to try to shut them up, and stop them from exposing what has been called “the greatest fraud in Canadian art history.” Matulic has amassed what can only be called a stunning collection of compromising documentary evidence that catalogues (my call) the history of the biggest hoax, as well as the biggest act of cultural genocide, in Canadian history. AFTER THIS PICTURE WAS TAKEN MATULIC WENT INSIDE... TOURED THE GALLERY, CHATTING AND SHAKING HANDS WITH JOHN MACGREGOR NEWMAN, THE ASSOCIATE DIRECTOR OF THE GALLERY. "The Plaintiffs have actively and deliberately taken action to corner the market in paintings by Norval Morrisseau. They are using their own position, as a former Morrisseau dealer, to inflate the value of their own holdings of Norval Morrisseau's paintings, and deflate the value of paintings held by Matulic, other Morrisseau collectors and art galleries all across Canada, by falsely claiming that many genuine Morrisseaus are forgeries, especially those signed on the back by the artist in black paint using drybrush (DB) technique. However several of these paintings have been positively confirmed for the signature authenticity by three independent forensic document examiners from Ottawa, Toronto and Calgary."

"The Plaintiffs along with other individuals have attacked Matulic's personal and professional reputation in an attempt to devalue paintings from Matulic's personal collection calling them forgeries and abominations."

As per December 31st, 2010 post by KRG blog at http://genuinemorrisseau.blogspot.com/ it is stated that allegations presented on the NORVAL MORRISSEAU BLOG referring to Kinsman Robinson Galleries "are unfair and false, offensive, mean-spirited" and "were published either with the knowledge that they were false, or with conscious disregard for the truth." (click HERE) This post has been since deleted by KRG blog editors.
Because of that they sued me for $500,000.00 for libel in respect of the alleged defamatory words posted on my blog at http://norvalmorrisseau.blogspot.com/. Also, for punitive, aggravated, special and exemplary damages in the amount of $500,000.00.
It is also important to note that the Plaintiffs never sued any originators of the alleged libelous statements, to whom I had linked. It was obvious that their action was intended to interfere with my right to freedom of expression. They intended to keep me quiet (they have never sued an alleged forger or distributor of forgers. Nor did they sue or return paintings to Randy Potter of Randy Potter Estate Auction of Port Hope, Ontario).
In July 2011 my legal counsel requested the Plaintiffs to provide particulars of the precise Defamatory Words for each individual Blog post and the meaning ascribed to them that the Plaintiffs allege were false and maliciously published or republished as articles on the “Norval Morrisseau Blog” on the dates listed in their Statement of Claim.
In August 2011 legal counsel for the Plaintiffs (Mr. Eric N. Hoffstein) responded that "these particulars were not necessary for pleading and are more properly the subject of discovery." Mr. Hoffstein also stated that "the particulars of the damages suffered by the Plaintiff will be provided during the discovery process." Then at a later date they tried to skip the discovery process by proposing the mandatory mediation. I strongly objected their proposal and advised my lawyer to go for the discovery first where I would demand from the Plaintiffs all documents which they have hidden from the public since 2001.
Also, it is important to note that the Plaintiffs offered to settle twice over the course of two years and even during lunch break, in the midst of the first day of Discovery, outside of the deposition room. On all three occasions I totally and utterly refused to settle out-of-court with the Plaintiffs...
> Kinsman Robinson Galleries originally demanded that I do not publish any negative comments in any form about Donald Robinson, Paul Robinson or Kinsman Robinson Galleries or any of its principals or employees. In one of their offers to settle they even asked for me to pay for their legal costs with a very strange request. They were prepared to consider alternate payment arrangements, which might include accepting artwork instead of cash. If I preferred I could have paid them with art from my collection and they were "prepared to accept a risk of selling such art".
This is strange as they were in full support of Mr. Ritchie Sinclair who claims that I am "a spokesperson for a forgery ring" and that I personally own "hundreds of fake Norval Morrisseau paintings" (click HERE and/or HERE). Mr. Sinclair is an operator of a malicious and defamatory website WWW.MORRISSEAU.COM that claims that over 1,000 Morrisseau paintings - 99% of which he has never seen in person - are forgeries.

NOTE: THE ONLY documents Plaintiffs submitted for Discovery were the posts listed in their STATEMENT OF CLAIM (see below under "ADDITIONAL INFORMATION") and correspondence with two of their clients including an e-mail from Mr. James Schuster and two e-mails from Mr. Edward Morrasut who expressed interest in purchasing the painting above "Legendary Omish-Shoo's", which was offered to him for $10,000 by Kinsman Robinson Galleries).
Also, Mr. Sinclair promoted paintings offered for sale by Kinsman Robinson Galleries in 2010 while labeling authentic Norval Morrisseau paintings as fakes or forgeries offered for sale at the same time in Webster Galleries, Calgary, Alberta (see images above or click HERE & HERE).
The same Mr. Sinclair for whom Mr. Donald Robinson stated the following: "I would like to recognize Ritchie Sinclair for his efforts to identify Norval’s true artistic legacy." /"EXPERT REPORT" ; September 10th, 2009; Page 74/.
It is worth noting that the Plaintiffs and Mr. Ritchie Sinclair showed disrespectful behaviour towards some of the Woodland painters... specifically 'attacking' the artistic integrity of the prominent Anishinaabe painter Mr. Don Ningewance. Mr. Sinclair even lebeled Mr. Don Ningewance as a Norval Morrisseau Art Forger (click HERE for more info).

Otavnik vs. Sinclair & Hatfield vs. Artworld of Sherway). Both, Mr. Donald Robinson and Mr. Ritchie Sinclair, together with Mr. Robinson's "Expert Report", were discredited by the recent court ruling of April 2nd, 2013.
As per the suggestion of my legal counsel (Mr. Antonin I. Pribetic) I was advised that when the case goes for trial that I would not be able to retrieve more than 50% of the legal costs. The only way I could get approximately 75% of the costs back would be if I offer to settle without cost.
Right after the release of the Hatfield judgment, KRG's legal counsel told my lawyer they would accept my offer of June 22nd, 2012. But then they dawdled and dawdled, obviously trying to delay, perhaps indefinitely, until I instructed my lawyer in mid May 2013 to demand definite information. He would have filed to have their acceptance of the offer enforced by the courts, which would have involved considerable cost to them (my costs as well as theirs). Then they signed (click HERE).
"When I was told that Donald Robinson’s son Paul would appear on Donald Robinson’s behalf, on the Plaintiff’s Discovery day, “due to (Donald Robinson’s) health issues and lack of preparation,” I aborted, demanding that Donald Robinson had to appear. I demanded Discovery be held in May, and with Donald Robinson in attendance.
I attended the Discovery on February 27th, 2013. I had to come from Calgary, which was costly, including my lost wages, and the cost of the flight and accommodation. I was questioned for seven hours by the Plaintiffs' legal counsel, Ms. Chloe Snider (the Plaintiffs were not in attendance?).
I revealed that I had thorough and complete backup to all my allegations with very good documents. Ms. Snider announced that she was not going to produce Mr. Donald Robinson to be questioned the following day...
In any event, the Plaintiffs signed the Full and Final Release dropping all charges against me as soon as the judgement by Judge Paul J. Martial in Hatfield vs. Artworld of Sherway was announced.
This means that I would be totally free to write as before, about Donald Robinson, Paul Robinson, John MacGregor Newman, and Kinsman Robinson Galleries, as their activities relate to the Hoax of the so-called “fakes” they allege.
I was in the process of submitting a long list of documents they would be required to produce that they have hidden from public scrutiny for the last 13 years. And they knew that is what they would have to reveal. Also financial documents, which actually show their profits went up from the Hoax, and not down from my revelations.
"Matulic commenced his Blog almost four years ago following false statements made publicly by the Plaintiffs and other individuals who were closely associated with the Plaintiffs regarding the authenticity of many Norval Morrisseau's paintings which these individuals called 'questionable', 'fakes', 'forgeries', 'abominations' and other defamatory attributes. Matulic felt the need to create a platform that would speak for Norval Morrisseau when this privilege to speak for himself was put in the hands of others who were only interested in their personal financial gain all the while putting the Legacy of Norval Morrisseau aside."

I very successfully succeeded in defending this frivolous SLAPP suit and I will continue pursuing our mission of seeking justice for Norval Morrisseau and his art, which is a vital aspect of Canada’s heritage.
And SLAPP suits like this to silence those like me who try to put the truth in front of the public will soon be a thing of the past in Ontario.
“The Province of Quebec has already enacted legislation against SLAPP SUITS (“strategic litigation against public participation”).
Now the Attorney General for Ontario has introduced a bill to ban these nuisance lawsuits, intended to terrorize and silence bloggers and journalists who bring important public issues out in the open. It is expected that the Ontario bill will be passed in the fall, as it has strong support from the NDP, whose members will vote with the minority Liberal Government to make sure it passes before the next Ontario election is held.”

This $ 1 Million SLAPP suit, defended by Ugo Matulic, was brought by Kinsman Robinson Galleries in an attempt to silence a blogger determined to reveal the truth to the public about a hoax that has destroyed millions of dollars worth of assets held by Canadian and international collectors, art dealers, galleries and museums.

It is surprising to see that Kinsman Robinson Galleries used these comments by their Associate Director, Mr. John MacGregor Newman, who concealed his true identity, to try undermining my credibility and consequently causing devaluation of my Norval Morrisseau art collection and destroying millions of dollars worth of assets held by Canadian and international collectors, art dealers, galleries and museums.
These comments by Mr. John MacGregor Newman were posted at the same time frame when KRG Blog post with racist slant under the title "Will the real SpiritWalker please stand up?" was published. If you read the last comment posted on August 10th, 2008 by "Principal Morrisseau Dealer" they were endorsing, with malicious intent, anonymous comment from the Tribal Artery Blog which states the NORVAL MORRISSEAU BLOG, maintained by myself, "is an insult and a great shame in that it is promoting garbage made to deceive buyers" and connecting me with "promotion of this fraud as it relates to Morrisseau" and that I "should be ashamed" (click HERE & HERE).
Kinsman Robinson Galleries Blog kept this defamatory comment for almost a year until they deleted their blog in June 2009 (click HERE for KRG Blog screen capture prior to its deletion. See VERBATIM in the side bar (right side) of this anonymous comment which resided on on their blog for full ten months.

The painting once owned by Dr. Jonathan Browne titled "Grandfather Speaks of Great Ancestral Warrior, 1977", was also forensically authenticated by top internationally recognized Forensic Document Examiner and Handwriting Expert Kenneth J. Davies, B.Sc. C.Ga CFC in April 2012 (click HERE). This genuine Norval Morrisseau painting was labeled as a FAKE by members of the Norval Morrisseau Heritage Society (NMHS) - Click HERE & see Page 3. Also, bloggers's comments by 'thickblacklines', 'juscruzin' , 'three owls', 'itsallaboutart' and 'amysticguru' who, together with 'Hugh' and 'Bogus Myth Slayer' ('Bogus Myth Slayer'), were trying to destabilize the NORVAL MORRISSEAU BLOG. I allow them to post comments on this platform even they were obviously supporting the views of Kinsman Robinson Galleries.

These commenters, including the Plaintiffs ('Principal Morrisseau dealer'), tried to ridicule me and undermine my credibility with full approval of Kinsman Robinson Galleries blog editors.
~ Among other peculiar behaviours they have chosen to completely disregard forensic science particularly when it comes to authenticity of genuine Norval Morrisseau paintings signed by the artist in black paint using drybrush (DB) technique.
Mr. John Macgregor Newman was also active in placing his comments on KRG Blog as well on Mr. Mark Anthony Jacobson's blog @ rainbowthunderbird.blogspot.com
at approximately same time period in 2008. Mr. John Macgregor Newman also concealed his true identity and he also tried to ridicule me and undermine my credibility.

This acrylic painting on canvas titled "Water Spirts, 1979" was acquired by Mr. Ross from Mr. Anthony Martinenko, an art dealer from Winnipeg, Manitoba and originally came from private collection of Mr. Rolf Schneiders, Thunder Bay, Ontario.
~ The first ever genuine Norval Morrisseau painting in my art collection was also acquired from Mr. Anthony Martinenko and it also came from Mr. Rolf Schneiders' private collection (click HERE). Also, other galleries to which Mr. Anthony Martinenko was supplying genuine Norval Morrisseau paintings were Maslak McLeod Gallery, Toronto, Ontario; Bearclaw Gallery, Edmonton, Alberta and Northern Art Impressions Gallery, Lake Louise, Alberta; to name but a few.

~ You may view Mr. Mark Anthony Jacobson's opinions about two genuine Norval Morrisseau paintings "Water Spirit, 1979" and "Upper and Lower Worlds, 1978" which were authenticated by Norval Morrisseau in 2005 (click HERE).
Mr. Jacobson considers "Water Spirit, 1979" to be "an absolute piece of garbage" and goes on by saying that "this piece of shit painting deserves to be burned at stake." Also, for "Upper and Lower Worlds, 1978", in his opinion, he considers this painting "is fitting to be used as "ass wipe" and is suggesting to "use this roll of garbage at your discretion" as "you may not want to get "any on you"." This screen capture also comes with defamatory comments which are all deleted together with all defamatory post attacking all of those who supports the findings of forensic document examiners who confirmed that the paintings in question are genuine works of Norval Morrisseau.
If you pay attention to the comment of December 2nd, 2009; 4:45 PM you will see that Mr. Mark Anthony Jacobson approved the words to be posted where I was labeled as "an absolute criminal" and "blatant liar" who committed "cultural crimes', and that I am connected with "criminal empire" and "art fraud enterprise".
Mr. Jacobson was linking the readers of his blog to Dr. Jonathan Browne's www.morrisseaubyuersbeware.com, one of Mr. Ritchie Sinclair's websites and his "Norval Morrisseau Blog" (side bar) and to Kinsman Robinson Galleries website (bottom) - click HERE.
As per his latest blog post of June 25th, 2013 Mr. Mark Anthony Jacobson is advocating the destruction of thousands of genuine Norval Morrisseau paintings (click HERE or HERE).
~ Mr. Jacobson is actually only one of a handful individuals who have chosen to completely disregard forensic science particularly when it comes to authenticity of genuine Norval Morrisseau paintings signed by the artist in black paint using drybrush (DB) technique.
This act of cultural genocide by Mr. Bryant Ross of Coghlan Art Studio & Gallery was reported by Ms. Katie Mercer ("The Province" reporter) in "Portrait of a scandal" article which content was in full support by Kinsman Robinson Galleries posted on their twitter account at http://twitter.com/KinsmanRobinson (click HERE to view a twit which surfaced on the day of Ms. Katie Mercer's print/online article or click HERE for this twit's screen capture).
~ I even offered to pay for forensics to be conducted on 'Water Spirits, 1979' for signature proof analysis. Furthermore I was willing to pay to Mr. Bryant Ross for the painting regardless of the outcome for him to recover his purchasing loss ten years ago with Mr. Anthony Martinenko. Also, If the forensics came back proof positive I was willing to pay him the $25,000.00 for what the painting was valued at before his defacing of this genuine Norval Morrisseau painting.
